If cancellation occurs very close to the agreed start date, further charges may apply where we cannot reallocate labour or recover committed costs. We may reschedule work if weather conditions, supply issues, access problems, safety concerns, or circumstances outside our control make it impractical or unsafe to proceed. 4. Customer Responsibilities

You are responsible for ensuring that the property is safe and accessible for the agreed works. This includes providing accurate information about boundaries, ownership, permissions, underground services, shared access, and any restrictions imposed by landlords, management companies, neighbours, or local regulations. You must obtain any necessary permissions, consents, licences, or approvals required for the project unless we have expressly agreed in writing to do so on your behalf.

Where our work depends on utilities, you must ensure appropriate power, water, or other facilities are available unless otherwise agreed. You should also tell us about hidden pipes, cables, drains, soakaways, tree roots, unstable structures, or contaminated ground. Although we take reasonable care, we rely on the accuracy of the information provided. If inaccurate information causes damage, delay, or extra work, the cost may be charged to you.

You should inspect completed work promptly and notify us of any concerns within a reasonable time. Minor settling, seasonal movement, and natural changes in living materials are normal in landscaping and do not necessarily indicate poor workmanship. 5. Materials, Plants, and Site Conditions

If we do proceed, any warranty or guarantee may be limited because we did not source the item ourselves. Replacement or correction costs caused by defective customer-supplied materials may be payable by you.

Unexpected ground conditions can affect landscaping projects. These may include buried rubble, poor drainage, excessive clay, soft subsoil, roots, old foundations, or contamination. Where such conditions are discovered, we may need to modify the method of work, amend the quote, or pause the project to agree next steps. Any extra labour, materials, plant hire, or disposal costs arising from these conditions may be added to the final invoice.

6. Waste Removal and Environmental Compliance

Waste generated during the works may include soil, grass cuttings, branches, concrete, timber, packaging, and general green waste. We will handle waste in accordance with applicable UK waste regulations and environmental requirements. Where we remove waste as part of the service, we may transport it to licensed facilities, recycling centres, or other approved outlets. We reserve the right to segregate materials for reuse, recycling, recovery, or lawful disposal as appropriate.

You must not ask us to dispose of prohibited, hazardous, or unidentified materials without prior written agreement. These may include asbestos, chemicals, oils, contaminated soil, asbestos-containing products, medical waste, gas cylinders, or electrical equipment subject to special disposal rules. If such items are found on site, work may stop until the matter is assessed and a lawful disposal method is agreed. If the customer retains any waste, you remain responsible for storing, moving, and disposing of it lawfully. We do not accept responsibility for illegal fly-tipping, unlawful burning, or improper disposal caused by the customer or third parties after our work is complete.

7. Liability and Insurance

Landscaping work carries inherent risks, and while we take reasonable care, we cannot eliminate every possibility of damage or loss. We are responsible for loss or damage only where it is caused by our negligence, breach of contract, or failure to use reasonable skill and care. Our liability will not extend to losses that are indirect, unforeseeable, or caused by events outside our control, including severe weather, third-party interference, or hidden site defects.

We are not liable for pre-existing issues, including unstable structures, drainage problems, subsidence, defective materials already on site, or damage caused by natural wear and tear. We are also not responsible for damage arising from inaccurate information supplied by the customer or from instructions that conflict with safety requirements. It is your responsibility to protect valuables, vehicles, ornaments, and vulnerable items before work begins.

8. Complaints, Remedies, and Variations

If you believe there is a problem with the service, you should notify us within a reasonable time and provide enough detail for the issue to be investigated. We may ask for photographs, access to the site, or a short period to inspect the work. Where a legitimate issue is identified, we may offer to correct, repair, or complete the work within a reasonable timeframe. This remedy may be the first course of action before any other claim is considered.

No variation to these terms will be effective unless agreed by us in writing. This includes any promise to waive charges, extend deadlines, or alter the scope of liability. If we choose not to enforce a clause at any given time, that does not mean we waive our right to rely on it later. These terms together with the accepted quotation form the entire agreement between the parties unless a separate written contract states otherwise.

9. Governing Law
